Terms and Conditions for King Catering Marbella
Effective Date: January 1, 2026
Welcome to King Catering Marbella ("we," "us," or "our"). These Terms and Conditions govern your use of our website and the catering services we provide. By requesting a quote, making a booking, or paying a deposit, you agree to be bound by these Terms and Conditions.
Please read them carefully before booking your event.
1. General Provisions
These terms apply to all catering services provided by King Catering Marbella. Any variations to these terms must be agreed upon in writing by both parties.
2. Quotes and Bookings

Quotes: All quotes are valid for 25 days from the date of issue. Prices may be subject to change if the booking is not confirmed within this period.

Securing a Date: A booking is only confirmed once we have received the required non-refundable deposit (or valid proof of payment) and written confirmation from the client. Until the deposit or proof of payment is received, your event date remains open for other bookings.
3. Final Guest Numbers and Menu

Final Count: The final number of guests and menu selections must be confirmed in writing no later than 10 days prior to the event date.

Minimum Billing: Your final invoice will be based on this confirmed number. If the actual number of guests drops after this deadline, you will still be charged for the confirmed number. If the number of guests increases, we will do our best to accommodate, but this will result in additional charges.
4. Dietary Requirements and Allergies

Client Responsibility: It is the client’s strict responsibility to inform us of any food allergies, intolerances, or special dietary requirements among their guests at least 7 days before the event.

Allergen Disclaimer: While we take extreme care in preparing meals for specific dietary needs, our kitchen handles major allergens (such as nuts, dairy, gluten, shellfish, etc.). We cannot guarantee a 100% allergen-free environment and do not accept liability for severe allergic reactions caused by trace elements.
5. Payment Terms

Standard Catering Deposits: A 30% non-refundable deposit (or proof of payment) is required to secure standard catering bookings.

Delivery BBQ Deposits: For Delivery BBQ services, a 50% non-refundable deposit is required to secure the booking.

Delivery Boxes: Full payment for Delivery Boxes must be made on the day the order is placed.

Final Balance Payment: The remaining balance of your invoice can be paid in the following ways:

Bank Transfer: Must be completed and received at least 3 days before the event.

Cash or Card: Can be paid on the day of the event.

Additional Costs: Any extra charges incurred on the day of the event (e.g., extra hours of service, broken equipment, additional guests) will be invoiced separately and must be paid within 7 days of the event.
6. Cancellations by the Client
All cancellations must be made in writing. The following cancellation policy applies:

More than 60 days before the event: The deposit is retained, but no further charges apply.

Between 30 and 60 days before the event: You are liable for 45% of the total estimated invoice.

Less than 14 days before the event: You are liable for 100% of the total estimated invoice.
(Note: Cancellations made between 14 and 29 days prior to the event will default to the 45% liability bracket).
7. Cancellations by King Catering Marbella
In the highly unlikely event that we must cancel our services, we will notify you as soon as possible and refund all payments made to us in full. We will not be liable for any additional costs or compensation beyond the refund of payments received.
8. Venue Access and Logistics

Access & Unloading: The client must ensure there is adequate space for our vehicles to unload all catering equipment and provide clear, direct access to the venue setup area.

Access Fee: If proper access is not provided (e.g., extremely difficult terrain, multiple stairs without elevators, long distances from the unloading zone) requiring significant extra labour, a 15% surcharge will be added to the final invoice.
9. Staffing, Overtime, and Delays

Overtime: Quotes include a set amount of service time. If the event runs over the scheduled time, extra hourly rates per staff member will apply.

Client Delays: If the client delays the agreed-upon hour for the food service to begin, extra charges will apply for the required overtime, and we cannot guarantee the optimal quality of the food.
10. Food Safety and Leftovers
If the client requests to keep leftover food, King Catering Marbella will package and leave the leftovers with the client. However, once our staff has completed the service and left the premises, King Catering Marbella accepts no liability for the safety, handling, or quality of the leftover food.
11. Waste Disposal
Our team will safely remove and dispose of all the trash generated directly by our catering operations (e.g., our food prep, packaging, and kitchen waste). We are not responsible for clearing or disposing of general venue trash or trash generated by guests outside of our specific catering items.
12. Force Majeure
King Catering Marbella shall not be held liable for any failure or delay in performing our services due to circumstances beyond our reasonable control. This includes, but is not limited to: severe weather conditions, acts of nature, pandemics, strikes, power outages, traffic accidents, or failure of third-party suppliers.
13. Liability and Damages

Client Liability: The client is responsible for any damage or loss of catering equipment, glassware, crockery, or linens caused by the client or their guests during the event. Replacement costs will be invoiced to the client.

Our Liability: Our total liability to the client for any breach of these terms or negligence shall be limited to the total amount paid by the client for the catering services.
14. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Spain. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain.
